جنایت جنگی در یمن
از زمانی که داستان پر غصه‌ی یمن آغاز شد همه عقلای قوم سعی کردند سنگ انداخته‌شده در چاه نادانی را بیرون بیاورند اما نشد که نشد! و هنوز این داستان غم‌بار ادامه دارد. دو تن از اساتید حقوق‌دان مملکت ما نیز به خیل جمعیتی پیوسته‌اند که سعی دارند آن سنگ کذایی را از چاه بیرون بیاورند پس‌دست به کارشده نامه‌ای نوشته‌اند در حد بضاعت و توانایی خود به دادستانی دیوان بین‌المللی کیفری و پاسخی گرفته‌اند که متن فارسی و انگلیسی آن در ذیل می‌آید.

استحضار دارید که در تاریخ 25 مارس 2015 تاکنون دولت عربستان سعودی با ملت و کشور یمن وارد جنگ نظامی شده است .در طول فرایند تجاوز ، سعودی‌ها با هدایت حملات عمدی بر ضد مردم غیرنظامی خصوصاً زنان و کودکان که هیچ‌گونه مشارکتی در مخاصمات ندارند و همچنین با حمله و بمباران شهرها ، روستاها و مناطق مسکونی و غیرنظامی ( ساختمانهایی که برای مقاصد مذهبی ، آموزشی ، هنری ،علمی ، مراکز بیمارستانی و … فعالیت دارند) موجبات کشتار عمدی و صدمات شدید جسمی و رنج عظیم هزاران نفر از مردم غیرنظامی یمن را فراهم نموده‌اند که بدون شک اَعمال مذکور، از مصادیق جنایت جنــگی (موضوع ماده 8 ) و صلاحیت دیوان (موضوع ماده 5) می‌باشند . این‌جانبان به‌عنوان عضو جامعه‌ی حقوقی با استناد به مواد 13 و 15 اساسنامه و با توجه به وجود مبنای مستدل ، تحقیق و تعقیب در موضوع این جنایت را گزارش می‌نماییم و درخواست داریم با توجه به درک جامعه جهانی از ذات تشکیل دیوان و ارتباط این نهاد بین‌المللی با شــورای امنیت ،{ با وصف اعمال محدودیت صلاحیت دیوان نسبت به دول غیر متعاهد } انتظار می‌رود با دستور عالی‌جنابان، رأساً زمینه‌ی مجوز تحقیق و نتیجتاً تعقیب مرتکبین و مساعدت کنندگان این جنایات گسترده و سیستماتیک آغاز ، تا شاید انتظار اقناع و ارجاع شورای امنیت از این طریق و به‌موجب فصل هفتم منشور ملل متحد به دیوان حاصل شود . ما در جهت مثبت ادعای خود علاوه بر وجود اسناد و مدارک و شواهد موجود در محل وقوع جرم ، گزارش مجامع بین‌المللی و در رأس آن به اظهارات ریاست سازمان ملل عالی‌جناب بان‌کی‌مون دراین خصـــــوص اشاره می‌داریم .

As you know from March 25 th2015 e Saudi Arabica State has begun a military war against Yemen State and nation until now. During the process of aggression , the Saudis have provided causes of Intentionally directing attacks and sever physical injuries and suffered massive and deliberate killing thousands of civilian people of Yemen with direction of intentional attacks against civilian people , especially women and children who have not participation in war and also with attack and the bombardment of towns, villages and residential and civil areas (buildings that are active for religious , educational, artistic, scientific intentions, medical centers, etc. ) that undoubted the mentioned auctioned actions are instances of war crimes (Article 8) and jurisdiction of court (Article 5). We as members of the Law Society according to Articles 13 and 15 of the statute and as for And due to the existence of reasonable grounds to investigate and prosecute these crimes report and ask according to understanding of international community from the nature of court formation and the connection of this international aestivation with Security Council by doing limitation of court ‘s qualification toward non-warrantor states is expected to emit the ground of inquest permit and as a result prosecution of perpetrators and accommodators of this widespread and systematic crimes . by Excellencie’s orders until maybe the expectation of satisfaction and reference of Security Council by this way and according to seventh chapter of United Nations charter is acquired to court .In this regard we allude to statements of UN Secretary General Mr. Ban Ki-moon in the positive direction of our claims in addition to existence of documents and available evidences in Crime scene.
